The Constitution of the Federal Democratic Republic of Ceni
Article 1. The people of Ceni have rested under an unorganized and chaotic government. This document sets out to ensure the Cenians have a satisfactory that they approve of and to ensure the Cenians get the rights they deserve, so this constitution goes into effect to do just that.
Article 2. Any sector, planetary, or national government may not make a law banning or limiting the freedoms of speech, association, or petition. Moreover, these rights shall not be abolished or limited at time of war or at any time.
Article 3. No planet, sector, or national government shall ban freedom of religion. The government shall not encourage or force people into believing in a religion, nor shall they denounce religion. Religious belief shall not be a requirement for an office under this federation.
Article 4. No government shall make a law banning or limiting freedom of the press.
Article 5. No search or seizure of people, property, or papers will be permitted unless a warrant is issued or proper compensation given. To receive a warrant, a probable cause must be stated and an oath or affirmation given, and must describe the place to be searched and the persons or objects to be seized.
Article 6. No person will be subject to double jeopardy, or shall be compelled to testify against himself, nor deprived of life, liberty, or property without due process of law. Any property taken for public use must be compensated for.
Article 7. In all criminal prosecutions, the accused shall enjoy the right to a fair and public trial by an impartial jury of the sector and planet where the crime was committed, and to be informed of the crimes he supposedly committed; to have compulsory process for obtaining witnesses in his defense, and to have the assistance of a lawyer or counsel for his defense.
Article 8. In all civil cases where the sum in question is $50000 the year this is adopted, plus inflation, shall be preserved.
Article 9. Courts may not impose excessive bail or fines or cruel and/or unusual punishments.
Article 10. Any citizen over the age of 18 or the respective age in each species may vote in any election, but must follow the laws governing elections.
Article 11. Neither slavery nor involuntary servitude, except as punishment for a crime for which the party has been duly convicted, shall not be permitted in Ceni.
Article 12. No organization, group, or government may discriminate on the basis of species, gender, race, or any other factor,
Article 13. The death penalty shall be abolished.
Article 14. The right of habeas corpus shall not be suspended at any time.
Article 15. No soldiers shall be quartered in any house during peace or war without the consent of the owner.
Article 16.No person shall be forced by the government to turn over any private records or any other private matter without due process of law.
Article 17. In all trials, a person shall be presumed innocent until proven guilty.
Article 18. All governments must provide the right to education, and must provide free, mandatory schooling from the ages 5 till 18 or the respective ages in each species that is neutral, and that neutrality includes the respect of the philosophical, ideological, and religious views of the parents and the pupil among others.
Article 19. All people have the right to social security, although taxation may be imposed to provide this service.
Article 20. All people have the right to work in just work conditions, with fair remuneration and the right to information, consultation, and collective bargaining.
Article 21. All people have the right to health care.
Article 22. All people have the right to social, medical, and legal consultation.
Article 23. All people have the right to decent housing.
Article 24. All people have the right to cultural and social development.
Article 25. All people have the right to life, liberty, and the pursuit of happiness.
Article 26. Citizens may get together to form a militia, and the right to keep and bear arms will not be abridged, but the Cenian Assembly may restrict or regulate the purchase of weaponry.
Article 27. Everybody is equal before the law, and no title of nobility may be granted by this nation.
Article 28. None of these rights may be abridged, banned, or limited in any time of peace or war.
Article 29. None of these rights may be abridged, banned, or limited to a certain group based on species, gender, race, or any other factor.
Article 30. If a right is not listed here, it belongs to the people or the sectors.
Article 31. These sections establish the government of the Federal Democratic Republic of Ceni.
Article 32. The Federal Democratic Republic of Ceni is a representative federal government.
Article 33. The executive branch of Ceni shall consist of a chancellor, a Council of Ministers and a Council of Species.
Article 34. The chancellor and deputy chancellor shall be elected by a public vote every 5 years.
Article 35. The Council of Species will be made up of 1 member of each species, appointed by the chancellor for a term of 5 years and approved by the Senate.
Article 36. The Council of Ministers shall be made up of a minister of the following departments: state, defence, finance, commerce, the General Ministry, and the Justice department headed by the Attorney General. They shall advise the Chancellor, and be appointed by him and approved by the Senate.
Article 37.Nobody except a natural born citizen, a citizen born to Cenian parents abroad, who has attained the age of 35 or the respective age in each species, may be chancellor.
Article 38. In case of impeachment, death, incapability, or resignation, the deputy chancellor shall take over the duties of Chancellor and becomes the Acting chancellor. If the deputy chancellor has the before said issues, the Cenian Assembly shall declare which officer shall act as chancellor until the disability is removed or a new Chancellor is elected.
Article 39. The chancellor and deputy chancellor shall receive compensation for their services, but the compensation may not change or any emolument given during his term.
Article 40. Before he takes office, the chancellor shall take the following oath or affirmation: “I solemnly swear (or affirm) that I will faithfully execute the office of Chancellor of Ceni, and will do to the best of my abilities to preserve, protect, and defend the constitution of Ceni.”
Article 41. The Chancellor shall be commander in chief of Ceni’s armed forces; he may require the written opinion of the ministers on any subject relating to the duties of their respective offices; he may grant pardons and reprieves for crimes against Ceni except impeachment; he can make treaties with a 75% senate majority; he can appoint ambassadors, judges to the Supreme Court, other public ministers and consuls, and other offices whose appointments are not provided in this constitution and which will be established by law with the Senate’s approval.
Article 42. He shall have the power to cover any vacancies that may happen during the recess of the Senate by granting commissions which shall expire at the end of their next session.
Article 43. He shall take care are laws are faithfully executed; give the Cenian Assembly information on the state of the Union from time to time; he may convene all of the houses or any of them on extraordinary occasions; in case of disagreement between the houses, he may adjourn them to such time as he thinks proper; and he shall receive all foreign ambassadors and public figures.
Article 44. The Chancellor and deputy chancellor and other officers can be impeached for conviction of treason, bribery, or other high crimes and misdemeanors.
Article 45. The Election Day will take place on November 1, and the inauguration will take place on January 1.
Article 46. The Chancellor, may be removed if a referendum called by a petition with 1.5 trillion names disapproves of his leadership.
Article 47. The legislative powers granted shall be vested in the Cenian Assembly, although referendums may be called.
Article 48. The Cenian Assembly shall consist of a senate, an Assembly of Planets and an Assembly of Sectors.
Article 49. The Senate shall be composed of 2 senators from each sector for a term of 5 years.
Article 50. To be a senator, you must be 30 or the respective age in each species and lived in Ceni for 9 years, and live in the sector in which you shall represent.
Article 51. The deputy chancellor shall serve as president of the Senate, but shall have no vote unless they shall be equally divided.
Article 52. The Senate shall choose their other officers, and a president pro tempore who shall act as president when the deputy chancellor is absent or is serving as acting chancellor.
Article 53. The Senate shall have the sole power to ratify treaties, confirm officers, and try impeachments.
Article 54. When impeaching an official, they shall be on oath or affirmation under the chief justice. No person shall be convicted without a 2/3 majority vote.
Article 55.When impeachment occurs, The only consequence shall be removal from office and disqualification to hold any office of trust or profit under this federation, but the party convicted shall be subject to indictment, trial, judgment, conviction, and punishment according to law.
Article 56. The Assembly of Sectors shall be composed of as many members as 100 billion per sector for a term of 2 years.
Article 57. The Assemblypeople have to be 25 years old or the respective age in each species and have to live in Ceni for 7 years. They must reside in the district they represent.
Article 58. Each sector must have at least 1 representative.
Article 59. The Assembly shall choose its speaker and other officers.
Article 60. The Assembly shall choose its members to sit on committees.
Article 61. The Assembly of Planets shall consist of 1 member from each planet.
Article 62. Members of the Assembly of Planets must be 21 and must have lived in Ceni for 6 years. They must live on the planet they represent.
Article 63. The Assembly shall choose its chancellor and other officers.
Article 64. The Assembly shall choose its members to sit on committees.
Article 65. The Assembly shall have the sole power to originate bills.
Article 66. Each house may determine the rules of its proceedings.
Article 67. A quorum must be held for any house to conduct business.
Article 68. Each house may punish its members for disorderly behavior and may expel a member with a 2/3 majority.
Article 69. Each house shall keep a journal of its proceedings, and the votes of each of its members shall be entered if 1/5 members agree to do so, and shall publish it from time to time, excepting such parts that require secrecy.
Article 70. Neither house may adjourn for more than 3 days without the consent of the other 2 during any session of The Cenian Assembly.
Article 71. All bills must originate in the Assembly of Planets.
Article 72. The bills go from the Assembly of Planets on up to the Assembly of Sectors and finally the Senate. If it passes the Senate, it goes to the Chancellor to be signed. If he signs it within 10 days, it becomes a law. He may veto it, writing his objections on it. I 2/3 members of all houses reapprove it, it will become a law. If the chancellor does not sign it in 10 days, it becomes a law unless the Cenian Assembly has adjourned at that time, in which case it dies.
Article 73. The Cenian assembly has the power to collect taxes; lay duties; pay debts; provide for the common defense and general welfare of Ceni; to borrow money; to regulate commerce with foreign powers and between the sectors; to establish an uniform rate of naturalization; establish uniform laws on bankruptcies; to coin money and regulate its value and the value of foreign coin; to provide punishment for counterfeiting; establish post offices; promote science and the arts by allowing authors and scientists the rights to their discoveries and works for a limited time; to constitute tribunals inferior to the Supreme Court; to define and punish piracies and felonies committed in space; to declare war; declare letters of marque and reprisal; raise and support armies; to provide and maintain a navy; to make rules for the government; to provide for calling upon the militia to execute laws, suppress insurrections and repel invasions; to provide for organizing, arming, and disciplining militias; and to make all laws which shall be necessary and proper to carry into execution allow of the powers given to the government by this constitution.
Article 74. No bill of attainder or ex post facto laws shall be passed; no tax or duty laid on articles exported from any sector; no preference shall be given to the starports of one sector, nor shall vessels bound to or from a sector shall not be obliged to enter, clear, or pay duties to another; and no money shall be drawn from the treasury except in consequence of appropriations made by law, and a regular statement and account of the receipts and expenditures of all public money shall be published from time to time.
Article 75. No person holding an office or trust or profit under Ceni shall accept any present, emolument, or office of any kind whatever from any foreign state without the Cenian Assembly’s approval.
Article 76. The judicial power of Ceni shall be vested in a Supreme Court and such inferior courts that the Cenian Assembly may establish.
Article 77.The Supreme Court shall consist of 11 justices and 1 chief justice who will serve for life or until they retire.
Article 78. The judges of the Supreme and inferior courts shall hold good behavior during their offices and receive a compensation at stated times.
Article 79. The judicial power shall extend to all cases arising under this constitution; the laws of Ceni; treaties made; to all cases affecting ambassadors, consuls and other public ministers; to all cases of admiralty and space jurisdiction; to controversies involving Ceni, between 2 or more sectors, between citizens of different sectors, and between sectors and their citizens and foreign countries and their citizens or subjects.
Article 80. In cases involving ambassadors, consuls, other public ministers, and those in which a state shall be a party, the Supreme Court shall have original jurisdiction.
Article 81. In all other cases, the Supreme Court shall have appellate jurisdiction.
Article 82. The trial of all crimes except impeachment shall be trial by jury.
Article 83. Such trial shall be in the sector where the crime was committed, but if it was not committed within any sector, it shall be at places the Cenian Assembly has directed by law.
Article 84. The courts may decide a law is unconstitutional, and may wipe it off the books if they believe it is so.
Article 85. Full faith and credit shall be given by each sector to public acts, records, and judicial proceedings of any other sector.
Article 86.The citizens of each sector shall be entitled to all privileges and immunities as citizens in other sectors.
Article 87. Any person charged with a crime in one sector that flees that sector into another one, and shall be found there, shall be removed to the original sector upon the demand of the executive authority there.
Article 88. No sector may enter into any treaty, alliance, or confederation; grant letters of marque and reprisal; pass any bill of attainder or ex post facto law or law impairing the obligation of contracts; grant any title of nobility; coin money; enter into a compact with another state or with a foreign power; engage in war unless actually invaded; or lay any import or export taxes without the consent of the Cenian Assembly, and all such laws are subject to the revision and control of the Cenian Assembly.
Article 89. New sectors may be admitted by the Cenian Assembly, but no new sectors shall be formed or erected within the jurisdiction of one sector, nor shall any sector be formed by the junction of 2 or more sectors or parts of sectors without the consent of the legislatures of the sectors concerned, as well as of the Cenian Assembly.
Article 90. New sectors shall have the same rights as old sectors.
Article 91. The FRD of Ceni shall guarantee every sector in this union a republican form of government, and shall protect each of them against invasion and against domestic violence on the application of the legislature or the executive when the legislative cannot be convened.
Article 92. 2/3 of the sectors may call for a new Constitutional Convention, and at such conventions, ¾ of the states must ratify an amendment for it to go into effect.
Article 93. The Cenian Assembly may propose amendments, and with a vote of 2/3 of all houses, it goes to the sector legislatures to vote on unless otherwise stated for ratification. ¾ of the sectors must approve a new amendment for it to go into effect. The Cenian Assembly may set a time limit for ratification, but that is not required.
Article 94. All debts engaged and engagements entered to before the engagement of this constitution shall be valid against Ceni under this constitution.
Article 95. The Constitution is the Supreme law of the land.
Article 96. Federal laws have supremacy over state laws.
Article 97. All legislative, executive, and judicial officers under this Union must swear or affirm to support this constitution.
Article 98. 100 sectors must ratify this constitution in order for it to become valid in the sectors that have ratified it.
